Older Workers Benefit Protection Act (OWBPA)

The Older Workers Benefit Protection Act (OWBPA) amended the Age Discrimination in Employment Act (ADEA) to safeguard older workers’ (those who are at least 40 years of age) employee benefits from age discrimination. Employers must pay the same amount for each benefit provided to an older worker as is paid for a younger worker, and mandates that older workers are given a 21 day consideration period and a 7 day revocation period as it relates to severance agreements.
